INDIGENT JUVENILES, THEIR FAMILIES, AND THEIR ATTORNEYS REVIEW CRITICALLY 13 OF THE 24 JUVENILE JUSTICE STANDARDS VOLUMES DRAFTED BY THE INSTITUTE OF JUDICIAL ADMINISTRATION AND THE AMERICAN BAR ASSOCIATION.
Abstract
THE CRITIQUE WAS UNDERTAKEN BECAUSE THE POOR AND THEIR ADVOCATES HAD NOT BEEN SIGNIFICANTLY INVOLVED IN THE DRAFTING OF THE STANDARDS. TASK FORCES OF LEGAL SERVICES AND JUVENILE DEFENDER ATTORNEYS ANALYZED THE STANDARDS AND DRAFTED REPORTS, WHICH WERE REVIEWED BY OTHER ATTORNEYS AND BY INDIGENT JUVENILES AND FAMILIES FAMILIAR WITH JUVENILE COURT DELINQUENCY AND NEGLECT OR DEPENDENCY PROCEEDINGS. OVER 50 ATTORNEYS AND CLIENTS REVIEWED THE 13 VOLUMES COVERED IN THE PHASE 2 REPORT. (SEE NCJ-53068 FOR PHASE 1.) THE REPORT SUMMARIZES THE REVIEWERS' FINDINGS AND RECOMMENDATIONS FOR EACH VOLUME. THE VOLUMES ON ARCHITECTURE OF FACILITIES, CORRECTIONS ADMINISTRATION, DISPOSITIONS, INTERIM STATUS, JUVENILE DELINQUENCY AND SANCTIONS, JUVENILE PROBATION FUNCTION, JUVENILE RECORDS AND INFORMATION SYSTEMS, PLANNING FOR JUVENILE JUSTICE, POLICE HANDLING OF JUVENILE PROBLEMS, AND SCHOOLS AND EDUCATION ARE APPROVED. PARTIAL APPROVAL IN PRINCIPLE IS GIVEN FOR THE VOLUME ON NONCRIMINAL MISBEHAVIOR. THE REVIEWERS CRITICIZE STANDARDS IN THIS VOLUME RELATING TO POLICE DETENTION OF ENDANGERED CHILDREN AND TO MENTALLY DISORDERED JUVENILES, SUGGEST AMENDMENTS, AND RECOMMEND THE ADDITION OF A PROCEDURE BY WHICH JUVENILES MAY APPLY TO THE COURT FOR EMANCIPATION FROM THEIR PARENTS. THE REVIEWERS NEITHER APPROVE NOR DISAPPROVE THE VOLUMES ON MONITORING AND YOUTH SERVICE AGENCIES, SUGGESTING AMENDMENTS TO BOTH VOLUMES AND QUESTIONING THE WISDOM OF ENCOURAGING THE CONTINUING EXISTENCE OF YOUTH SERVICES BUREAUS.
