AN AMENDMENT TO THE CONSUMER CREDIT PROTECTION ACT MAKES CERTAIN DEBT COLLECTION PRACTICES ILLEGAL AND PROVIDES FOR CIVIL LIABILITY IN CASES OF UNFAIR DEBT COLLECTION PRACTICES. IT BECAME EFFECTIVE IN 1978.
Abstract
THIS AMENDMENT ADDS A NEW TITLE 8 TO THE CONSUMER CREDIT PROTECTION ACT. TITLE 8 COVERS HARASSMENT OF DEBTORS, ABUSE, USE OF OBSCENE LANGUAGE, FALSE OR MISLEADING REPRESENTATIONS ON THE PART OF PERSONS ATTEMPTING TO COLLECT A DEBT, LEGAL ACTIONS WHICH ARE AND ARE NOT PERMITTED, MULTIPLE DEBTS, AND PROCEDURES TO BE FOLLOWED WHEN THE DEBT IS DISPUTED. THE CIVIL LIABILITY OF THE DEBT COLLECTOR IS SPELLED OUT. THE FINAL SECTIONS PROVIDE FOR ADMINISTRATIVE ENFORCEMENT BY THE FEDERAL TRADE COMMISSION. IT DOES NOT ANNUL ANY STATE LAWS. STATE LAWS TAKE PRECEDENCE IF THEY ARE SIMILAR TO THIS LAW AND ARE CONSIDERED ADEQUATE TO PROTECT THE CONSUMER. THIS LEGISLATION WAS APPROVED BY THE PRESIDENT ON SEPTEMBER 20, 1977, AND BECAME EFFECTIVE 6 MONTHS LATER. (GLR)
