THIS INTRODUCTION TO COMPARISONS BETWEEN WESTERN AND ASIAN AND PACIFIC ATTITUDES TOWARD LAW EXAMINES LEGAL TRADITIONS, PRACTICE, AND INNOVATIONS IN THE LIGHT OF CULTURE.
Abstract
ASIAN AND PACIFIC COUNTRIES HAVE NOT ENCOUNTERED SOME OF THE LAW ENFORCEMENT PROBLEMS FOUND IN THE WEST, NOR DO THEY HAVE THE CAPACITY TO WRITE ABOUT THEIR PROBLEMS IN EUROPEAN LANGUAGES. EASTERN CRIMINAL JUSTICE AUTHORITIES FACE LITTLE ARGUMENT ABOUT LAW, RETAIN THE CONFIDENCE AND RESPECT OF THE POPULATION, AND FIND THAT SOME OF THE POLITICAL, ECONOMIC AND SOCIAL CHANGES THAT FOLLOWED WORLD WAR II HAVE STRENGTHENED THEIR CRIMINAL JUSTICE SYSTEMS. GENERALLY, CHANGES IN LAW IN THESE COUNTRIES HAVE OCCURRED IN LINE WITH CHANGES IN NATIONAL AND CULTURAL TRADITIONS, RATHER THAN THROUGH REVISIONS. THE SPECIFIC PROBLEMS CONFRONTED BY ASIA AND THE PACIFIC MAY BE THE SAME AS THOSE BEING DEALT WITH BY WESTERN COUNTRIES, BUT THEY ARE OFTEN HANDLED QUITE DIFFERENTLY. CASES IN POINT THAT ARE DISCUSSED ARE PAPUA NEW GUINEA'S ADOPTING OF THE COMMUNITY INVOLVEMENT APPROACH AND COMPENSATION OF VICTIMS, AND ASIA'S MANAGEMENT OF AN EXTENDED SYSTEM OF APPEALS.
