CONSIDERATIONS OF THE POLICE SURGEON REGARDING EXAMINATION OF VICTIMS OF SEXUAL OFFENSES ARE PRESENTED; TOPICS INCLUDE CRIMINAL CLASSIFICATION OF OFFENSES, CLINICAL EXAMINATION, AND SPECIMEN COLLECTION.
Abstract
CRIMINAL SEXUAL OFFENSES WITH WHICH THE POLICE SURGEON WILL HAVE TO CONTEND INCLUDE BUGGERY, ATTEMPT TO COMMIT BUGGERY, INDECENCY BETWEEN MALES, RAPE, INDECENT ASSAULT ON A FEMALE, UNLAWFUL SEXUAL INTERCOURSE WITH A MINOR, INCEST, PROCURATION, ABDUCTION, BIGAMY, AND GROSS INDECENCY WITH A CHILD. CASES OF RAPE ARE THE MOST FREQUENT OF THESE OFFENSES. IN ADDITION TO THE GENERAL PRINCIPLES WHICH APPLY TO ANY EXAMINATION OF LIVING PERSONS, MAINTAINING THE DIGNITY OF THE PATIENT, PRESENCE OF A THIRD PARTY, CONSENT, AND ACCURATE RECORDING OF THE COMPLAINT ARE IMPERATIVE. VICTIM EXAMINATION IN AN ALLEGED RAPE SHOULD INCLUDE RECORDING MANNER AND DRESS, STATE OF CLOTHES, GENERAL PHYSIQUE, PHYSICAL WEAKNESS OR DEFORMITY, APPARENT AGE, HEIGHT, WEIGHT, INTELLECTUAL ABILITY, MARKS OF RESTRAINT, LESIONS, STAINS, GENITAL DEVELOPMENT, EFFECTS OF DRUGS OR ALCOHOL, AND ANY MARKS OF INJURY. EXAMINATION OF THE GENITALS IS THE ALL-IMPORTANT PART OF THE EXAMINATION; THE POLICE SURGEON SHOULD CAREFULLY NOTE ANY SMEARS, STAINS, FOREIGN PARTICLES, INFESTATION, DISEASE, VAGINAL DISCHARGE, MENSTRUAL DISCHARGE, REDNESS, SWELLING, BRUISES, TEARS, SCRATCHES, AND BLEEDING. EXAMINATION OF THE ACCUSED SHOULD INCLUDE THE SAME GENERAL INFORMATION, E.G., APPARENT AGE AND INTELLECTUAL ABILITY. GENITAL EXAMINATION SHOULD FOCUS ON INJURIES, DISCHARGE, AND STAINS OR SMEARS. THE POLICE SURGEON MAY ENCOUNTER EVIDENCE OF ACTS PERFORMED FOR SEXUAL GRATIFICATION INCLUDING CUNNILINGUS, FELLATIO, AND SADO-MASOCHISM: RECOGNITION OF THE EFFECTS OF SUCH ACTS IS VITAL TO AN ACCURATE EVALUATION. SPECIMENS WHICH SHOULD BE COLLECTED FROM THE VICTIM AND THE ACCUSED FOR ANALYSIS INCLUDE CLOTHING, FOREIGN PARTICLES, NAIL SCRAPINGS, SALIVA FROM BITE MARKS, SCALP HAIR, COSMETICS, BLOOD, PUBIC HAIR, AND SWABS FROM GENITALS.
