THIS BOOKLET PRESENTS THE FULL TEXT OF THE AMENDED 1978 ETHICS IN GOVERNMENT ACT, WHICH REQUIRES FINANCIAL DISCLOSURE FOR CERTAIN FEDERAL EMPLOYEES AND LIMITS POSTEMPLOYMENT CONFLICTS OF INTEREST.
Abstract
THE LAW WAS APPROVED BY CONGRESS IN 1978 AND AMENDED IN 1979. THE LAW PROVIDES FOR FINANCIAL DISCLOSURE OF OFFICIALS AND KEY EMPLOYEES OF EACH OF THE THREE BRANCHES OF THE FEDERAL GOVERNMENT. IT ALSO ESTABLISHES AN OFFICE OF GOVERNMENT ETHICS, WITH A DESCRIPTION OF THE OFFICE'S AUTHORITY, FUNCTIONS, ADMINISTRATIVE PROVISIONS, AND AUTHORIZATION OF APPROPRIATIONS PROCEDURES. THE LAW BARS CERTAIN ACTIVITIES AND SOURCES OF INCOME FOR FORMER OFFICERS AND EMPLOYEES OF THE U.S. GOVERNMENT. DIFFERENT TIME LIMITS ARE SPECIFIED FOR EACH ACTIVITY. IT PROVIDES FOR APPOINTMENT OF A SPECIAL PROSECUTOR TO INVESTIGATE AND PROSECUTE SUSPECTED VIOLATIONS. THE PROSECUTOR'S AUTHORITY, DUTIES, AND MEANS OF APPOINTMENT AND REMOVAL ARE NOTED. FINALLY, IT PROVIDES FOR THE ESTABLISHMENT OF AN OFFICE OF SENATE LEGAL COUNSEL. THE OFFICE'S ROLE IS TO DEFEND SENATE MEMBERS, COMMITTEES, SUBCOMMITTEES, OFFICERS, OR EMPLOYEES. THE LEGISLATIVE HISTORY AND EFFECTIVE DATE OF EACH PART OF THE LAW ARE ALSO PRESENTED. (CFW)
