THIS MANUAL PROVIDES LAW ENFORCEMENT PERSONNEL WITH BASIC OPERATIONAL KNOWLEDGE OF THE IMPACT OF CONSTITUTIONAL LAW ON POLICE PRACTICES.
Abstract
ALTHOUGH CASE CITATIONS ARE NOT INCLUDED, THE STATEMENTS AND RULES ARE DERIVED FROM THE MOST RECENT U.S. SUPREME COURT DECISIONS AND REPRESENT THAT WHICH THE CONSTITUTION PERMITS, REQUIRES, OR FORBIDS. THE INFORMATION IS INTENDED FOR USE AT THE OPERATIONAL LEVEL AND IS TABBED TO PROVIDE READY ACCESS. CROSS-REFERENCES ARE ALSO PROVIDED. EARLY SECTIONS FOCUS ON CONFRONTATIONS WITH THE SUSPECT AND ON STOP AND FRISK PROCEDURES. A SECTION ON IN-FIELD OR ON-THE-SCENE IDENTIFICATIONS INCLUDES INFORMATION ON IDENTIFICATION BY WITNESSES IN DANGER OF DEATH AND ON IMMEDIATE IDENTIFICATION DEMANDED BY A SUSPECT. ALSO CONSIDERED ARE IDENTIFICATION BY WITNESSES WITHOUT POLICE PARTICIPATION AND PHOTOGRAPH IDENTIFICATION. AN ARREST SECTION REVIEWS THE REPQUIREMENTS FOR AN ARREST, THE USE OF FORCE, AND WARRANT REQUIREMENTS. INFORMATION ON SEARCHES INCIDENTAL TO ARRESTS FOCUSSES ON PLAIN VIEW, THE SCOPE OF SEARCH, AUTOMOBILE SEARCHES, HOT PURSUIT, AND THE OBTAINING OF PHYSICAL EVIDENCE FROM SUSPECTS. A FURTHER SECTION CONSIDERS INTERROGATION FROM THE VIEWPOINT OF REQUIRED WARNINGS. ANOTHER IS CONCERNED WITH SEARCHES WITH AND WITHOUT WARRANTS, PSEUDO-SEARCHES, AUTOMOBILE INVENTORIES, AND ADMINISTRATIVE SEARCH WARRANTS. FINALLY, POLICE SURVEILLANCE WITH AND WITHOUT ELECTRONIC DEVICES AND ENTRAPMENT ARE REVIEWED. SPACE FOR NOTES ARE PROVIDED.
