INFORMATION ON COURT COSTS AND LEGAL AID IN CRIMINAL CASES IS PRESENTED IN A GUIDE FOR BRITISH LEGAL PRACTITIONERS AND STUDENTS.
Abstract
THE PURPOSE OF THE GUIDE IS TO PROVIDE A CONCISE EXPLANATION OF STATUTORY AND NONSTATUTORY PROVISIONS GOVERNING THE ALLOCATION OF COURT COSTS AT EACH TIER OF THE BRITISH CRIMINAL COURT STRUCTURE. THE FIRST SEVEN SECTIONS DEAL WITH PROSECUTION AND DEFENSE COSTS INTER PARTES (PAID BY THE PROSECUTION OR THE DEFENSE) AND FROM CENTRAL FUNDS, FOR VARIOUS TYPES OF COURTS AND PROCEEDINGS. OTHER SECTIONS EXAMINE APPEALS AGAINST COST ORDERS, TAXATION OF COSTS, AND WITNESS EXPENSES. THE LAW GOVERNING LEGAL AID IN CRIMINAL CASES IS ALSO COVERED, AS ARE COMPENSATION ORDERS; ENFORCEMENT OF ORDERS FOR COSTS, COMPENSATION, AND LEGAL AID CONTRIBUTIONS AND WAIVERS; MATTERS OF INTEREST TO LOCAL AUTHORITIES; AND THE CRIMINAL INJURIES COMPENSATION SCHEME.
