LEGAL CITATIONS, PUNISHMENTS, AND OTHER FACTORS FOR MAJOR CATEGORIES OF CRIME ARE PRESENTED TO ASSIST NORTH CAROLINA POLICE IN DECIDING WHAT OFFENSE TO CHARGE AND HOW TO GATHER EVIDENCE.
Abstract
FOLLOWING AN INTRODUCTION TO CRIMINAL STATES OF MIND, CRIMINAL DEFENSES, AND PARTICIPANTS IN CRIME, SEPARATE SECTIONS DISCUSS MAJOR CRIME CATEGORIES. MATERIAL ON EACH OFFENSE WITHIN A CATEGORY INCLUDES THE RELATED STATUTE, ELEMENTS OF THE OFFENSE, PUNISHMENT FOR THE OFFENSE, FURTHER NOTES ON LEGAL POINTS ABOUT THE OFFENSE, AND NAMES OF RELATED OFFENSES. STATUTES ARE REPRODUCED, OR IF THE OFFENSE IS RECOGNIZED ONLY IN CASES DECIDED BY STATE COURTS, IT IS NOTED AS 'COMMON LAW.' PUNISHMENTS ARE ALWAYS FINES OR IMPRISONMENT, WHICH MAY BE DETERMINED BY THE JUDGE. RELATED OFFENSES ARE DEEMED IMPORTANT FOR POLICE OFFICERS TO REVIEW, SINCE THEY MAY BE CHARGEABLE ALONG WITH, OR PREFERRABLE TO, THE CHOSEN CHARGE. ALTHOUGH THE VOLUME DOES NOT GIVE COMPLETE LEGAL AUTHORITY FOR EVERY POINT MADE, IT DOES CITE SOME LEGAL AUTHORITIES AS RESOURCE MATERIAL. CATEGORIES OF CRIME DISCUSSED INCLUDE GENERAL CRIMES (I.E., COMPOUNDING A FELONY); HOMICIDE; ASSAULT; SEXUAL ASSAULT; ROBBERY, BLACKMAIL, EXTORTION, AND KIDNAPPING; BURGLARY AND BREAKING AND ENTERING; ARSON; TRESPASS AND PROPERTY DAMAGE; LARCENY; FRAUD; DISORDERLY CONDUCT AND RIOT; WEAPONS OFFENSES; DRUG OFFENSES; PROSTITUTIONS; AND OTHERS. INDEXES ARE INCLUDED.
