To help Oregon defendants charged with a traffic infraction represent themselves in traffic court, this manual outlines the traffic code, technical defenses, evidence presentation and more.
Abstract
The new Motor Vehicle Code, enacted in July 1977, simplified traffic court precedure and decriminalizes most violations. The law also equalizes the footing of the defendant and the police officer in court. For this reason, it is possible for the defendants charged with traffic infractions to defend themselves successfully in traffic court without the help of an attorney. In preparing cases for trial the defendants should determine exactly what they are charged with, consider defects in the summons, and obtain 'discovery' from the district attorney. They must do research so that they are able to understand the law and the rules of evidence, organize their theory of defense, and prepare the case and the witnesses. They should also visit the courthouse prior to the trial. Oregon Uniform Traffic Complaint and Summons, examples of infractions with essential evidence lacking, and a sample of pretrial discovery letter are presented as aids. In addition a list of fines for infractions, and of a addresses and phone numbers of Motor Vehicles Division Field Offices are provided. Finally, a presentation of traffic citation requirements, exceptions, and uniform citations is included.
