This is a summary of the new Indiana Juvenile Code which went into effect on October 1, 1979, and the General Assembly ammendments which took effect in October 1980. The Code is the first major revision of the Indiana's juvenile laws since 1945.
Abstract
The main body of the Code is organized into 11 chapters located in Article 6 (Juvenile Law) of Title 31 (Family Law) of the Indiana Code. In addition, Public Law No. 136 (1978) and No. 276 (1979) containing amendments for relevant statutes located in other titles of the Indiana Code have been enacted to ensure their consistency with the new Juvenile Code. According to the Code, the juvenile court has exclusive, original jurisdiction over proceedings involving delinquent children as well as children in need of services (CHINS) and their detention, and proceedings involving termination of parental care, or its inclusion in a treatment or rehabilitation program of a child. In addition, the juvenile court has concurrent original jurisdiction in cases involving adults charged with neglect of a dependent, contributing to delinquency, or violating the compulsory attendance law. Definitions of delinquent child and CHINS, the procedures involving custody, detention, and mental and physical examination, as well as other juvenile court procedures are included. The rights of children and parents are also outlined. A glossary, and a background summary and flow chart of the new Code are also included. The 1980 General Assembly Ammendments are appended.
