The text is intended for lawyers, law enforcement and prosecution officials, and students. An introductory chapter discusses searches and seizures as defined in the Federal Constitution; legislative enactments in conflict with the Constitution; and searches and seizures by Federal officers acting in concert with State police. A number of chapters are concerned with the law of arrest as it relates to arrests without warrants, to searches and seizures, and to the classification of searches. Arrest is defined, and the requirements for valid arrests are delineated. In addition, defects in warrants of arrest and the execution of warrants of arrest receive attention. Other chapters examine various aspects of the search warrant: seizures under the authority of search warrants; waivers of privilege; affidavits for search warrants; issuance and types of warrants; and their execution and enforcement. Challenges to the seizure of property are the subject of a further chapter which includes information on proprietary interest, waivers of the right to challenge, and forfeiture proceedings. A final chapter focuses on self-incrimination and discusses compulsory intoxication, mental and physical tests of accused persons, and the waiver of self-incrimination rights.
