This appendix for juvenile justice reform advocates contains samples of pleadings, briefs, unpublished opinions, and other legal materials relating to issues under the Juvenile Justice and Delinquency Prevention Act.
Abstract
In most instances, the original papers or slightly modified versions have been included, while in others, portions of papers from different cases have been combined. Each document is current regarding the cases it describes only as to the date each was developed or filed, and introductory comments are current as of 1980. The materials are concerned with such issues as the incarceration of juveniles in jail, solitary confinement without a hearing and under harsh cell conditions, questionnaires for institutionalized youths, compelling the production of important documents, interrogatories to institutional defendants and medical interrogatories, and the treatment of mental health handicaps. Others relate to jailing challenges in Federal courts, the application of the Federal Civil Rights Act to private juvenile residential facilities, the secure confinement of status offenders, and the right to treatment for institutionalized juveniles. Probable cause hearings, complaints about institutional conditions, proposed rules for the operation of a juvenile detention facility, and the recovery of attorney's fees are subjects of further documents.
