This package which is designed to instruct police officers in methods for investigating lesser crimes against persons includes an audio cassette, a film strip, and a workbook for participants.
Abstract
An unlawful attempt to apply force or violence to another person, coupled with the ability to apply the force, is assault. If the attempt is carried out, the suspect is charged with battery. To support a charge of battery, a charge of assault must first be supported. Assault with a deadly weapon can be established as corpus delicti if the force was applied repeatedly and resulted in moderate injury. Assault with intent to murder can be established if the excessive unlawful force caused serious injury, but not death. Assault leading to death can lead to a charge of murder or manslaughter. Two other types of assault crimes are identified. Attempt crimes are those which have been caused to fail. Impossible crimes are those in which the suspect would not be physically capable of carrying out the crime due to factors beyond the control or knowledge of the suspect. Attempt crime corpus delicti exclude factors concerned with criminal preparations. An attempt charge cannot be made until a direct, overt act has occurred. The workbook includes a unit overview, test questions, and supplementary activities, and the instructional material is designed for individualized use. An instructor test key is included.
