This procedure manual is designed to simplify and facilitate the total transfer process for the interstate and intrastate transfer of probationers who are subject to supervision in New York State.
Abstract
The primary target groups for the manual are those persons responsible for out-of State and New York State probationers who receive probation service under the terms of the interstate compact. The text of rules, regulations, and forms included in the procedure manual are in accordance with those found in the basic compact. Major categories of subjects addressed are laws, rules, and standards of the compact; eligibility for supervision; standards and procedures regarding supervision; standards of reciprocal supervision; visits; retaking cases from another jurisdiction; compact forms; and interstate compact on juveniles. The compact and manual provide that each receiving State will assume the duties of visitation of and supervision over probationers or parolees of any sending state, and that in the exercise of those duties each State will be governed by the same standards that prevail for its own probationers and parolees. Kinds of transfer specifically addressed include intrastate transfer to a new county, interstate transfer of a New York State probationer previously transferred within New York State, and change in residence of a probationer within a receiving county.
