Prepared for Arkansas residents, this guide describes the functions of the State Consumer Protection Division and explains the State's consumer protection laws.
Abstract
The Consumer Protection Division of the attorney general's office was created in 1971 to handle complaints about fraudulent and deceptive practices, investigate violations of consumer protection laws, and promote consumer education. The division's educational efforts include radio and television programs, pamphlets, and conferences. Division counselors give advice about good buying practices and information on laws affecting consumers. The division tries to mediate disputes between consumers and businesses and is authorized to file lawsuits against individuals and businesses who violate the Consumer Protection Code. Practices in the advertisement or sale of goods and services which are forbidden by the Code are described, such as pyramiding devices, bait and switch tactics, and failure to provide warranty information. The Home Solicitation Sales Act, or the 3-day cooling off law, is explained. This allows a purchaser to cancel a contract for an unsolicited sale made at home for $25 or more within 3 days. Procedures for filing complaints ara detailed, and the address and telephone number of the Consumer Protection Division are given. General advice to consumers covers mail order purchases, automobiles, and contracts. Other State and Federal agencies which handle consumer complaints are listed.
