These four papers give step-by-step directions on how prosecutors should conduct voir dire to produce the selection of jurors most likely to return a verdict of guilty.
Abstract
All the papers emphasize the importance of good preparation for voir dire. For example, the prosecutor should gain knowledge of the prospective jurors' backgrounds. Notes with questions for jurors should be prepared ahead of time. The papers also explain what the prosecutor can do to make a good impression on jurors. Among recommendations are the treatment of prospective jurors as equals during questioning, the use of conservative dress, and the use of a conversational style. Recommended techniques during the conduct of the voir dire include maintenance of eye contact with the juror being questioned, avoidance of flattery, and use of a positive approach during questioning. The papers also discuss factors to consider in jury selection, including relationships among the jurors, and jurors' reactions to the defendant and the case. In addition, one paper discusses such issues as categories of challenges and the historical background of the practice of jury selection. Another paper cites the relevant case law.
