This discussion paper has been prepared for the Wisconsin Legislative Council's Special Committee on Pretrial Release to aid the committee in formulating its recommendations about pretrial release in Wisconsin.
Abstract
The paper contains a brief description of the current State practice regarding pretrial release pursuant to the issuance of a citation or summons. It discusses the pretrial release standards of the National Association of Pretrial Services Agencies (NAPSA) and the American Bar Association (ABA) regarding the use of citations and summonses and provides information on the use of these devices in other States. Following this discussion, a list of options for possible changes in existing Wisconsin statutes and practice is presented. Footnotes are provided, and relevant NAPSA and ABA standards are appended.
