Issues raised by the Committee on Civil Practice include the controversial one of the practice of law in New Jersey by out-of-state firms. Dissenting opinions are presented by individual members of the committee and the crucial differences concern the interpretation of a 'principal' versus a 'bona fide' law office. The committee also reports that it is considering a counsel fee rule and standards for amicus curiae procedures, an area where none currently exist. Difficulties with interpreting filiation and bastardy rules and obtaining child support monies from absconding fathers through jury trial are explained. Finally, a program for trial advocacy specialization is introduced. The program involves certifying specialized trial attorneys and making this information available to the consumer public. A secondary advantage of the program would be its impetus for lawyers to improve their professional skills. Requirements for certification as a trial lawyer would include membership in the bar, passing a certification examination, extensive prior experience as a trial lawyer, study or instruction at professional seminars, professional publications, and an oral examination testing excellence in examination skills and trial techniques. Under the proposed program, certification would last 7 years; some part of the qualifying procedure might have to be reviewed before renewal.
