The process of developing a restitution contract (mediation) is analyzed for a juvenile restitution program in the District of Columbia.
Abstract
Mediations observed for analysis consisted of 23 cases of alternative to probation and 2 cases of alternative to incarceration. Of the observed meditations, 23 developed contracts acceptable to the court, while one juvenile, his/her attorney, and at least one program representative (probation officer or community service worker) be presented. The victim is not required to participate in the mediation. Victim advocates hire by the program may represent victim interests in the meditation content, most mediations discussed each of 17 topics. Participants interactions varied according to discussion topics. The topic of 'recommendations' occasioned the greatest interaction, followed by 'potential placements.'
