Based on a study done in the early 1970's, this article analyzes data on the various stages in the disposition process of felony cases.
Abstract
The process is followed from arrest to final disposition through plea bargaining, trial, or dismissal of the case. The analysis was undertaken because even though much is known about the disposition of felony arrests that reach the trial stage, little knowledge exists about the details of the dispositions reached without trial. The latter category forms over 90 percent (98 percent in New York) of all dispositions. The study focused on a sample of 369 cases; interviews were conducted with the arresting police officer, the assistant district attorney, the defense counsel, and the judge about the respective part each played in the process that culminated in the disposition. The analysis of the data is presented in 23 graphs that illustrate the pretrial disposition pattern and throw particular light on the plea bargaining process. Tabular data and footnotes are also provided.
