This study explores sexual assault issues in Hawaii today, reviews statutory revisions implemented in other jurisdictions, and proposes amendments to Hawaii's sexual offense statute.
Abstract
All available studies recommend revising the sex offense laws. The case for revision is so strong that Hawaii should only be concerned with what form the new statute will take. The new law must afford equal protection for all citizens against violence, and must move the focus of prosecution from the victim's conduct to the defendant's. The statute modifies certain definitions, adds new definitions, and consolidates the offenses of rape, sodomy, and sex abuse into the offense of sexual assault. It also offers four degrees of sexual assault. Footnotes and about 20 references are included. The survey instrument and tables showing each State's statutory provisions regarding sexual assault are included. (Author abstract modified)
