This pamphlet outlines the legal responsibility of local school districts in New York to locate, identify, and provide services to jailed youths. It discusses methods that school superintendents, sheriffs, and corrections and school staff can use to provide instruction to such youth.
Abstract
The district in which the youth is incarcerated must provide educational services. Any youth who would be required to attend school if not jailed must receive instruction while jailed. Educational programs for jailed youth should include a regular school curriculum, a high school equivalency preparation program, basic literacy skills, and occupational and special education. The responsible school district can arrange for educational services through direct tutoring, a contract with a school or school district, or contracting with boards of cooperative educational services. Mandated responsibilities of county jails and school districts in this area are outlined, and funding sources are identified. Legal references are cited.
