The idea of sentences proportionate to the gravity of the criminal conduct has been generating interest in the Scandinavian countries, as well as in the United States.
Abstract
This article, based on a lecture given by the author at the University of Oslo, explores Scandinavian ideas of 'neoclassicism' in sentencing. Drawing on the Scandinavian literature, the author examines the conceptual basis for the idea of proportionate (deserved) sentences, and explores the justification for the existence of the criminal sanction.
