This report is offered for consideration by the Nebraska supreme court in resolving whether it should adopt and implement guidelines for use by sentencing judges.
Abstract
The investigation on which this report is based found that sentencing disparity, though present, is not extreme in Nebraska, according to statistical evidence. The study proposes that sentencing guidelines not be adopted as a way to reduce the level of Nebraska's sentencing disparity. As an alternative to presumptive sentencing guidelines, the report recommends that a statewide sentencing reporting system be developed and that sentencing information be regularly disseminated to all Nebraska judges. 12 references.
