This booklet presents the arbitration rules, involving both structure and procedure, for the General Arbitration Council of the Textile and Apparel Industries, a division of the American Arbitration Association (as amended and in effect April 1, 1982).
Abstract
The opening section presents suggested arbitration clauses for the arbitration of future disputes and for the submission of existing disputes. One rule specifies the composition of the General Arbitration Council, and another makes provision for the delegation of Council duties. Specification for an official panel of arbitrators indicates that it shall include but is not limited to members of the various divisions of the textile/apparel industries represented in the Council. Rules on procedure and staffing cover such issues as initiation under an arbitration provision in a contract, expedited procedures of arbitration, change of claim, number of arbitrators, arbitrator qualifications, disclosure and challenge procedure, order of proceedings, arbitration in the absence of a party, evidence, waivers, extensions of time, communication with arbitrator and serving of notices, and the time, form, and scope of the award. Rules also cover administrative fees and expenses as well as means of expediting procedures. In addition to the rules, information is provided on the administrative fee schedule, other service charges, postponement fees, and the refund schedule.
