This report, which recommends passage of the Comprehensive Crime Control Act of 1983, presents a section-by-section analysis of its 12 titles, a cost estimate, and both minority and additional views.
Abstract
Title I substantially revises the Bail Reform Act of 1966, giving the courts authority to consider community safety in their bail decisions. Title II introduces sentencing reforms that address sentencing disparities and uncertainty about the time offenders will serve in prison. Title II is designed to enhance the use of forfeiture as a law enforcement tool in combating racketeering and drug trafficking. Title IV addresses laws relating to the insanity defense, narrowing the present definition, as well as Federal court procedures for defendants suffering mental disease or defects. Title V improves the penalty structure for major drug trafficking offenses and regulatory authority regarding controlled substances. A revised justice assistance program is authorized by Title VI, while Title VII authorizes the donation of surplus Federal property to any State for construction and modernization of criminal justice facilities. Title VIII affords unions and employee benefit plans greater protection from corrupt officials by increasing penalties for violating portions of existing labor laws. The next title amends currency and foreign transactions reporting laws to help the Government track money-laundering schemes. Title X consists of a group of miscellaneous violent crime amendments, Title XI of serious nonviolent crime amendments, and Title XII of procedural amendments to improve the operation of the Federal criminal justice system. The report contains a regulatory impact statement and information on the committee members' votes. Also presented are the changes in existing laws made by the bill.
