Abstract
A chapter introducing family mediation explains how it can help families resolve their disputes. Some of the necessary mediator skills are outlined. Finally, the advantages of family mediation over court litigation are demonstrated. The benefits of creating a working relationship between the parties are emphasized. Details of the family mediation process are discussed in another chapter, including a step-by-step description of the mediator's function. The mechanics of the negotiating process are covered, as are the practical techniques of the mediator. The attorney's role is outlined as well. Another chapter is devoted to divorce mediation, notably the tasks of the divorce mediator and child custody issues in mediation. A chapter is devoted to some practical questions that might be asked by someone who decides to act as a family mediator or assume this role as a professional. Issues covered include the difference between a mediator and a judge, what a mediator is expected to accomplish, the qualities required of a family mediator, the ethical aspects of a lawyer acting as mediator, whether a mediator can be totally impartial, and whether a family mediator is likely to be sued. Statutes and legal issues bearing upon the resolution of family disputes are discussed in the final chapter. The appendixes contain the American Arbitration Association (AAA) Family Mediation Rules, arbitration rules for the interpretation of separation agreements, a model 3-day family mediation training program, and an AAA sample form retainer agreement. References, a selected bibliography, and a subject index are provided.
