This document summarizes enacted and proposed State legislation on mediation and Federal legislation on alternative dispute resolution.
Abstract
Summaries and copies of enacted and proposed legislation on mediation are provided for 28 States, and copies of the following Federal bills are included: Dispute Resolution Act, State Justice Institute, U.S. Academy of Peace, Voluntary Arbitration of Patent Disputes, Voting Rights Act/Community Relations Service, and the Magnuson- Moss Warranty Federal Trade Commission Improvement Act. Summaries of Arizona, Colorado, Delaware, District of Columbia, Kentucky, Michigan, New York, and Washington court rules are provided, and copies of those rules, as well as the rules of Hawaii and of the Federal rule, are included. A draft model court rule, court rule overview, and court rule comments are presented. Other laws on mediation, including State 'lemon laws,' Federal pesticide legislation, and Rules of Conciliation and Arbitration of the International Chamber of Commerce, are presented. Model State legislation on mediation is discussed, and steps toward legislative passage are enumerated. South Carolina's sample Uniform Arbitration Act is provided, and citations to the arbitration statutes of the 50 States are noted. State legislative resources are listed, and cross references to legislation and court rules are listed under main subject and key provisions covered. Ten publications of the Special Committee on Alternative Means of Dispute Resolution are listed.
