A test sponsored by the National Institute of Justice and conducted by the Shelby County (Tennessee) Public Defender examined the effects of appointed counsel representing indigent felony defendants shortly after arrest.
Abstract
An interview counselor was hired to interview defendants and provisionally determine indigency prior to the first court appearance. During the test period, September 1982 - May 15, 1983, 2,119 clients were represented by the test and control staff. From the defense perspective, early representation had a positive impact on bail setting, because the defense counsel could present proof and argument on bail at the first appearance. Another benefit of early contact with defendants was an increased level of confidence and communication between the test attorneys and their clients. The services of a street investigator for the test group was also an invaluable aid. It is expected that the use of such an investigator will continue, although the financial arrangements are not yet complete. Forms and a description of the project's operating procedures are included.
