This resource packet contains overview materials on alternative dispute settlement; papers on the mechanics, legal issues, court rules, and State legislation involved in mediation programs; descriptions of six operation programs; a bibliography of 800 citations; and a dispute resolution program directory.
Abstract
Introductory materials cover trends in dispute resolution and the advantages of alternatives such as mediation to formal court processes. Several papers discuss planning and implementing a mediation center and assessing such programs. Specific areas addressed are funding, staffing, selecting mediators, training, and outreach to the legal community. A separate section profiles six different programs having excellent rapport with the local bar association. These programs differ in supporting organization, characteristics of mediators, funding sources, and center locations. Papers on legal issues consider confidentiality, liability, and enforceability. Examples of court rules governing dispute resolution mechanisms are drawn from Cincinnati, Ohio; New York City; Minnesota; and Kentucky. State legislation on alternative dispute resolution is reviewed also.
