This pamphlet, issued to all inmates under the jurisdiction of the Massachusetts Parole Board, explains the board's release decisionmaking process, including eligibility dates, mandatory sentences, early and special consideration, and the revocation and rescission process.
Abstract
The pamphlet uses a question-and-answer format. It details the authorized functions of the parole board and instructs inmates in how to determine their parole eligibility date. Offenses are listed for which Massachusetts law requires serving two-thirds of the sentence before parole eligibility; offenses that carry a mandatory number of years in prison before parole eligibility are also specified. The mandatory number of years are cited for each of the involved offenses. How mandatory sentences affect parole eligibility is also explained. The pamphlet provides the parole board's definition of 'prior commitment' and explains the 'Henschel Decision,' which permits the aggregation of sentences from different Massachusetts correctional institutions for parole purposes only. Also explained are the parole board release hearing process, functions of a hearing officer, and appeal of a board vote. The 'rescission' of a parole date, an institutional revocation hearing, parole release to a State other than Massachusetts, and functions of the Advisory Board of Pardons are described.
