The Swedish Code of Judicial Procedure is presented under the topics of court organization, judicial proceedings in general, evidence, lower court proceedings, appellate proceedings, supreme court proceedings, and extraordinary remedies for substantive defects and grave procedural errors.
Abstract
The chapters on court organization discuss general lower courts, court of appeals, and the supreme court. Other chapters in this section consider punishment, fines, and bringing to court; judges; right of public attendance and maintenance of order at court sessions; court protocols; public prosecutors and police authorities; and advocates. Chapters addressing judicial proceedings in general are classified under civil and criminal proceedings as well as regulations for both civil and criminal cases. Parts of the code dealing with evidence are presented in chapters on evidence in general, witnesses, examination of parties under the truth affirmation, documentary evidence, views, experts, and the perpetuation of proof for the future. Civil and criminal proceedings are encompassed in aspects of the code dealing with lower court proceedings. Chapters on appellate proceedings address appeals from judgments and orders of lower court, regular appeals in civil and criminal cases, limited appeals, and action commenced in courts of appeals. The code covers similar topics in delineating supreme court proceedings. Relief for substantive defects and restoration of expired time as well as relief for grave procedural errors are covered in the code's specification of extraordinary remedies.
