This volume provides a detailed analysis of Federal grand jury law and proceedings, particularly as they affect unindicted witnesses, so as to guide attorneys in representing such witnesses.
Abstract
An overview of grand jury procedure takes the attorney from the first contact with the person who has been or is about to be subpoenaed through various stages of preparation and preliminary motions as well as proceedings in the grand jury room and before the presiding judge. The overview also addresses the representation of witnesses who refuse to testify before the grand jury. Subsequent chapters provide a detailed legal analysis, including case citations, of the proceedings summarized in the overview. Chapters cover the subpoena, injunction and intervention, the selection and composition of the grand jury, the statutory and case law framework of Federal grand juries, appearance before the grand jury, first amendment rights before the grand jury and immunity, and the witness' right to privacy and protection against electronic surveillance. The latter chapters discuss testimonial privileges, grand jury secrecy, abuse of the grand jury process, prosecutorial misconduct, contempt, perjury, and obstruction of justice. Chapters are also devoted to postcontempt remedies and representing persons jailed for contempt. A glossary of grand jury terms is included, and the appendix contains sample pleadings. A table of cases and a subject index are also provided.
