Abstract
An overview of American labor law reviews labor in early America, the application of antitrust and anti-injunction laws to labor relations, and the National Labor Relations Act. The chapter on the union recognition process analyzes a union representation case and discusses special representation issues and alternative methods of achieving union recognition. The accommodation of union organizing interests and management property interests is considered in the chapter on the regulation of the union organizing campaign, along with the protection of employee choice. A chapter on collective bargaining considers the economic weapons in collective bargaining, the duty to bargain in good faith, the subject matter of collective bargaining, and the need for a meaningful remedy when an employer refuses to engage in collective bargaining. A discussion of the nature and administration of the collective bargaining agreement reviews the administration of grievance procedures and arbitration, judicial intervention, the role of the National Labor Relations Board, the relationship of arbitration and Title VII, and individual rights in contract administration. Other chapters address the union's duty to protect employee status and the statutory regulation of union economic pressure. The latter chapter focuses on organization picketing, secondary pressures, 'featherbedding,' work assignment disputes, and national emergency disputes. Chapter notes, a table of court cases, and a subject index are provided.
