In reviewing the British Prevention of Terrorism (Temporary Provisions) Act of 1984, this paper examines the extent to which the act incorporates the recommendations of the Jellicoe Report (a review of the 1976 Prevention of Terrorism Act) and how the 1976 and 1984 acts differ.
Abstract
The explanation and critique of the 1984 act covers provisions for the use of police powers against persons suspected of terrorist acts defined in the act and provisions for excluding terrorism suspects from those jurisdictions where suspected terrorist acts were perpetrated. Also considered are the substantive offenses specified in the act and the structure of the legislation. This study concludes that the 1984 act improves upon the 1976 act in its tactics for preventing terrorism, and it incorporates 59 of the 65 recommendations of the Jellicoe Report. Still, the paper reasons that the act does not have sufficient safeguards against government intrusion into citizens' civil liberties. Further, there is little innovative thinking shown in the means used to combat terrorism. The paper notes that registration with the police and electronic surveillance were not even considered.
