This report presents and comments on model State legislation on the subject of racketeer influenced and corrupt organizations.
Abstract
The model legislation is the product of 2 years of meetings and study by an American Bar Association (ABA) committee that has the task of studying State statutes, comparing them to Federal legislation, and evaluating them in view of problems that had arisen in both civil and criminal contexts. Each provision of the model legislation is accompanied by commentary from the majority that supported the provision and from the minority that opposed either the provision or some aspect of its wording. Appendixes present the August 1982 recommendation of the ABA House of Delegates on the Federal Racketeer Influenced and Corrupt Organizations statute, the text of the Federal law and a comparison of it and State law, the 1983 testimony regarding forfeiture legislation, and a statement of dissent to the model law. Footnotes and a list of the members of the committee that prepared the report are also supplied.
