Abstract
Pretrial release and appeal provisions cover constitutional issues, release/detention determinations and conditions, preventive detention, hearings, and sanctions for violations of release conditions. Mental health provisions deal with competency to stand trial, the insanity doctrine and its consequences, and treatment of mentally ill inmates. Among violent offenses dealt with are homicide, racketeering related violence, kidnapping, assault, and firearms offenses. Covered economic offenses include destruction of property, theft, fraud, bribery, forgery, and computer crime. Controlled substances provisions deal with drug regulation and drug-related crime. Among miscellaneous regulations are those relating to labor racketeering, financial reporting, pornography, and crimes affecting the administration of justice. Provisions also cover the structure of sentencing under the act, fines and their enforcement, and probation policies and procedures. Additional provisions deal with forfeiture proceedings, rules of evidence, justice assistance, and the powers of customs and secret service personnel. Juvenile justice provisions address the repeal of the Youth Corrections Act, prosecution of juveniles as adults, juvenile records, and missing children, and juvenile prevention programs. Finally, witness-victim protection provisions relate to victim restitution, compensation, intimidation, and the Federal witness protection program.
