A TERM-BY-TERM, CASE-BY-CASE REVIEW OF DECISIONS OF THE SUPREME COURT IN THE AREA OF CRIMINAL LAW SINCE THE SEARCH AND SEIZURE CASE OF MAPP V. OHIO.
Abstract
OVER 400 CASES DECIDED IN THE FIRST NINE TERMS OF THE 1960'S (THE 'REVOLUTION' IN THE COURT) AND THE SUBSEQUENT THREE TERMS (THE AFTERMATH OF THE REVOLUTION) ARE REVIEWED. EACH CASE IS CONCISELY ANALYZED AND ATTENTION IS DRAWN TO EARLIER CASES NOW OVERRULED OR FURTHER DELINEATED AND TO THE VIEWS OF DISSENTING JUSTICES. THE LANDMARK CASES ARE PLACED IN THE HISTORICAL CONTEXT OF THE LONG JUDICIAL STRUGGLE TO ENSURE THE RIGHTS OF CRIMINAL SUSPECTS, WHICH BEGAN ABOUT 30 YEARS AGO. (AUTHOR ABSTRACT)
