This guide presents a title-by-title explanation of the Federal Anti-Drug Abuse Act of 1988, which involves numerous, significant changes in Federal criminal law, not only in the area of drug enforcement but across the entire spectrum of the Federal criminal code.
Abstract
Title I, Coordination of National Drug Policy, institutionalizes a national drug control program and provides for Justice Department civil enforcement enhancement. Title II, Treatment and Prevention Programs, authorizes a variety of drug treatment and prevention programs; and Title III establishes and authorizes appropriations for a number of drug abuse education and prevention programs. Title IV provides a mechanism for United States consultation, coordination, and assistance to foreign countries in addressing international drug trafficking. Title V provides various means to enforce user accountability. Title VI, Anti-Drug Abuse Amendments Act of 1988, includes subtitles pertinent to chemical diversion and trafficking, asset forfeiture, State and local narcotics control and justice assistance, money laundering prosecution, firearms, Postal Service investigative powers, and manufacturing offenses. Other titles pertain to the Federal Alcohol Administration, the death penalty and other criminal law enforcement matters, miscellaneous provisions, and supplemental appropriations.
