This report by the Task Force of the Illinois State Bar Association on Bigotry in Schools includes a review of the nature and extent of the problem, a legal analysis of the issues, and proposals for preventive measures.
Abstract
The report notes that incidents of bigotry and prejudice in schools and on campuses are diverse and widespread and reflect pervasive racism, sexism, and homophobia in American society. In attempts to address the problem, schools are faced with a dilemma, i.e., the defense of free speech versus the right of all students to academic pursuits free of hatred and intimidation. The U.S. Supreme Court has thus far resolved this dilemma on a case-by-case basis, so school administrators have no clear guidelines on what measures to suppress bigotry and hatred will stand a test of constitutionality. This report does not recommend additional legislation designed to address bigotry and discrimination in schools, since it believes existing legislation provides a sufficient legal framework for action. Preventive measures should be the focus of school administrators. Suggested measures include a clear statement by school administrators that acts of prejudice will not be tolerated, formation of a bigotry response team to ensure prompt and appropriate responses to incidents, the use of suspension for violators of campus policy, immediate removal of graffiti, protection for threatened or injured students, victim services, training for staff and campus security, and a campus survey of the bigotry level.
