This memorandum outlines the major offenses and penalties for those offenses under the Controlled Substances Act and related provisions and cites relevant laws enacted through the 1991-1992 legislative session.
Abstract
The memorandum describes current prohibitions relating to the manufacture, delivery, possession with intent to deliver, and possession of controlled substances; controlled substances violations and sanctions applicable to persons under age 18; asset seizure and forfeiture for controlled substance violations; offenses and penalties pertaining to the possession, sale, or use of drug paraphernalia, including separate drug paraphernalia sanctions applicable to children; and miscellaneous offenses and sanctions. Tables specify the penalties for the illegal manufacture, delivery, or possession of controlled substances; the penalties for selected offenses; and the penalties for the sale, use, manufacture, or advertisement of drug paraphernalia. 6 tables and 1 appendix
