The Tribal Courts and State Courts: The Prevention and Resolution of Jurisdictional Disputes Project was initiated in 1989. It has been sponsored by the Conference of Chief Justices, funded by the State Justice Institute, and administered by the National Center for State Courts.
Abstract
The project was designed to address inter-system disputes that arise from the Indian Child Welfare Act, domestic relations matters, contracts, torts, taxation, economic development, hunting and fishing, highway traffic, and criminal cases. In an effort to induce the chief justice of every State with tribal courts to appoint and support a similar forum, this booklet discusses the purpose of the tribal/State court forum, the history of other such forums, the forum's primary tasks, its chairmen and members, and the role of a forum consultant and other forum staff. In addition, it describes the interpersonal dynamics of successful State forums, the agenda for the first meeting, potential roles for the public, other aspects of action and implementation plans, and possible sources of funding.
