This Information Memorandum defines the major offenses and penalties under Wisconsin's Controlled Substances Act and related provisions.
Abstract
Relevant laws enacted through the 1993-94 legislative session are included. An overview of the Uniform Controlled Substances Act is followed by a description of penalties for the manufacture, delivery, or possession of controlled substances. Another section profiles the waiver of juvenile court jurisdiction over children who commit certain serious drug offenses. Also described are penalties and license sanctions for, and other provisions applicable to, controlled substances offenses committed by children. A description of penalties and civil actions applicable to controlled substances offenses committed by gangs includes provisions for gang-related crime, a gang-related penalty enhancer, and civil action for criminal gang activity. Other major sections explain asset forfeiture and related issues, suspension or revocation of motor vehicle operating privilege, drug paraphernalia offenses and penalties, the revocation or suspension of alcohol beverage licenses and permits for drug-related activity, other controlled substances offenses and their penalties, and disciplinary sanctions for post-secondary students.
