Member states of the Council of Europe signed an agreement relating to the establishment of the European Court of Human Rights (ECHR) and to persons participating in proceedings of that court.
Abstract
The ECHR was established in response to an agreement signed in 1994 which establishes a permanent ECHR to replace the European Commission and Court of Human Rights. Persons to whom the agreement applies include persons taking part in proceedings before the court as parties, representatives, or advisors, as well as witnesses and experts called upon by the court to take part in proceedings. Other provisions of the agreement focus on the immunity of individuals participating in the ECHR from legal processes, the right of individuals to correspond freely with the ECHR, the implementation of decisions by the ECHR in member countries, and administrative aspects of implementing the agreement.
