This report describes the North Carolina Sentencing Commission's study process and summarizes the State's victim restitution procedures and practices.
Abstract
In North Carolina, victim restitution means monetary compensation to an aggrieved party for damage or loss. Victim restitution is authorized as a condition of probation, and as a "remedy to promote rehabilitation of criminal offenders, to provide compensation to victims of crime, and to reimburse the Crime Victims Compensation Fund." In addition to describing the Sentencing Commission's study process and the State's victim restitution scheme, the report includes a statement of purpose and policy principles, and 15 recommendations to enhance the system for ordering, collecting, monitoring, and enforcing victim restitution. The report also includes proposed legislation for certain recommendations, a statistical analysis of victim restitution ordered and collected in North Carolina, and a summary of restitution statutes in the United States.
