This guidebook on North Carolina substantive criminal law is designed to help law enforcement officers decide which offense should be charged, if any, and what evidence should be gathered to prepare a case for trial.
Abstract
This fourth edition incorporates statutory changes made through the 1995 session of the North Carolina General Assembly and case law through volume 340 of the North Carolina Reports and volume 118 of the North Carolina Court of Appeals Reports. The book attempts to cover all of the criminal offenses likely to be encountered by law enforcement officers in North Carolina, except for offenses in such special subjects as motor vehicle law, alcoholic beverage control law, and fish and game law. Introductory chapters cover states of mind, defenses, participants in crime, and punishment under structured sentencing. These chapters are followed by separate chapters on various major categories of offenses. The material on each offense within a category is divided into five sections: the statute, if any, dealing with the offense; the elements of the offense; the punishment for the offense; notes on legal points about and case law concerning the offense that are not evident in the listing of elements; and the names of related offenses not in the chapter.
