THE DEPORTABILITY OF ALIENS IS DISCUSSED WITH REGARD TO THE NATURE OF THEIR OFFENSES AND THE REMEDIES THAT ARE AVAILABLE.
Abstract
ALIENS CONVICTED OF THE SAME OFFENSE MAY OR MAY NOT BE DEPORTABLE, DEPENDING UPON WHETHER THEIR ATTORNEY OBTAINED A JUDICIAL RECOMMENDATION AGAINST THE DEPORTATION WITHIN THE 30-DAY TIME PERIOD, OR, IF A NARCOTIC CONVICTION IS EXPUNGED, WHETHER IT WAS PURSUANT TO A STATE OR FEDERAL REHABILITATION STATUTE. SINCE DEPORTATION MAY BE AN ADDED CONSEQUENCE FOR AN ALIEN CONVICTED OF, OR EVEN CHARGED WITH, A CRIMINAL OFFENSE, THE AUTHOR URGES DEFENSE ATTORNEYS TO KEEP IN MIND THE POSSIBILITY OF AMELIORATIVE RELIEF.
