This document presents the revised draft of a United Nations convention intended to promote international cooperation to prevent and address transnational organized crime more effectively.
Abstract
Some portions of the draft convention have been placed in brackets to indicate that the words, sentences, or paragraphs have not been discussed or that delegations have expressly stated that the text requires further consideration. The convention applies to the prevention, investigation, and prosecution of serious crime involving a transnational organized crime group. Individual components of the convention focus on the scope of its application, the meaning of terms used, the criminalization of participation in an organized criminal group, money laundering and actions to address it, and actions against corruption. Further sections focus on corporate criminal, civil, and administrative liability; the effective implementation of the convention; the confiscation of assets; international cooperation for purposes of confiscation; and the disposal of confiscated assets. Other sections focus on jurisdiction, extradition, mutual legal assistance, special investigative techniques, the transfer of proceedings from one jurisdiction to another, the protection of witnesses and victims, law enforcement cooperation, information collection and exchange, and training and technical assistance. Final, sections discuss crime prevention at the national and international levels, the role of the United Nations and other relevant organizations, the monitoring of implementation, the organization overseeing the convention's implementation, the secretariat, the relationship of this convention to other conventions, dispute settlement, amendment, and other topics.
