This article advocates redistribution of powers between courts.
Abstract
The article advocates redistribution of powers between the probation service and the public prosecution service regarding carrying out community sanctions. The article proposes the following: (1) separate the duties of the probation service regarding community sanctions from its other duties, i.e., aid and assistance and information to the court; (2) make that part of the probation service which deals with community sanctions the responsibility of the public prosecution service; and (3) let complaints about the execution of community sanctions not be handled by the probation service itself but by either an independent execution judge or a complaints department comparable to the complaint departments in prison.
