This report from the Centre for International Crime Prevention presents articles adopted by the General Assembly of the United Nations Convention Against Transnational Organized Crime.
Abstract
In the first part of this report the Convention seeks to promote cooperation to prevent and combat transnational organized crime more effectively. Discussing the scope of application, the protection of sovereignty, and the criminalization of participation in an organized criminal group, this document details articles addressing the criminalization of the laundering of proceeds of crime, measures to combat money laundering, criminalization of corruption, and measures against corruption. Articles discussing liability of legal persons, prosecution, adjudication, and sanctions, confiscation and seizure, and international cooperation for purposes of confiscation are followed by articles focusing on disposal of confiscated materials, jurisdiction, extradition, sentenced persons, and mutual legal assistance. Joint investigations, special investigative techniques, transfer of criminal proceedings, and the establishment of criminal record are discussed along with the criminalization of justice, protection of witnesses, and assistance to victims. Articles detailing cooperation with law enforcement, information exchange, technical assistance, prevention, and implementation of the convention are presented prior to articles focusing on relation protocol, amendment, denunciation, and depositary and languages. Part 2 of this United Nations Convention Report supplements the United Nations Convention Against Transnational Organized Crime by presenting a series of articles addressing the protocol to prevent, suppress, and punish trafficking in persons, especially women and children. The primary sections of this second part include general provisions; the protection of victims of trafficking in persons, prevention, cooperation; and other measures, and final provisions. In Part 3 of this Convention Report, protocols against the smuggling of migrants by land, sea, and air are discussed focusing on prevention, cooperation, and other measures. The last supplement to this United Nations Convention, Part 4, addresses articles highlighting protocol against the illicit manufacturing of and trafficking in firearms, their parts, components, and ammunition.
